给你家人最好的的保障:设立遗嘱 Protect your loved ones and assets through Will and Trust.

以前人们总是避讳立遗嘱, 以为这是”触霉头的事”。其实生老病死是一种自然规律, 与立遗嘱没有关系。相反, 为了避免子女在父母逝世后, 陷入财产和法律的纠纷中, 尽早设立遗嘱是很有必要的。除了老年人, 夫妻有了第一个小孩后就应该把保险和遗嘱规划安排好。因为当一个人逝世时, 他的所有财产将被冻结。

没有遗嘱, 要解冻逝世者的财产, 法庭将要求两名担保人提供管理保证金, 而保证金的数额必须相等于逝世者的遗产总值, 为了协助家人朋友解冻财产, 您会愿意成为那位担保人吗?

我国目前有600亿的遗产仍在冻结中, 百万片的土地还在先人名下, 上亿的EPF无法认领。就是因为目前马来西亚立遗嘱的人少过10%, 还是有很多人对遗嘱有所避讳和误解。

Death is not something we like to contemplate but it can strike anyone at any time. When that happens, the last thing we want is for our loved ones to struggle to make ends meet. Most Malaysians are oblivious that their assets could be frozen upon their demise, in accordance to the law without a will. They could become entangled in long drawn legal process and complex judiciary battle where the law would subsequently decide whom the beneficiaries should be.

A whopping RM 60 billion worth of assets left by Malaysians are yet to be claimed by their heirs because almost 90% of them die without writing a Will. All this assets has become an unclaimed money. Surely you wouldn’t want your assets to be in the statistic, so how can you avoid falling into that unfortunate category?

误解 1
遗嘱立了以后就不用一再修改 
A Will is valid for a lifetime

如果家庭情况有改变, 如: 新添了孩子或是夫妻婚姻发生变化, 却没有在遗嘱中得到及时修改, 就相当于埋下了潜在的纠纷。如果某人在签署遗嘱时是单身, 那么遗嘱在其婚后将自动失效, 然而离婚却不会废除遗嘱, 除非你进行修改。

No Will or any part thereof is revocable otherwise than in effect of marriage where it is revoked and becomes null or canceled by the testator’s marriage. A divorce however, does not revoke a Will. The Will speaks from its date as the beneficiary unless you mention a contrary intention in your Will.

 

误解 2
将临终前匆匆留下的遗言当成遗嘱

遗嘱是立遗嘱者一个意愿的宣言,一份合法的遗嘱, 必须符合下列5点:

  1. 遗嘱必须是以任何语言的语文手写或打字
  2. 立遗嘱人必须在2位见证人面前签署
  3. 2位见证人也必须在立遗嘱人面前签署
  4. 在西马和砂劳越,立遗嘱人必至少21岁)
  5. 立遗嘱人必须神志清醒

For a Will to be legally valid, the following rules apply:

  1. A Will can be written in any language.
  2. The Testator’s signature must be witnessed by at least two (2) persons who are NOT Beneficiaries under the Will and who are NOT the husband/wives of the Beneficiaries.
  3. An Executor who is NOT a Beneficiary or a husband/wife of any Beneficiary under the Will may witness the Will.
  4. The Testator must be at least 18 years of age (and 21 years for those in Sabah)
  5. The Testator must be mentally sound.

 

误解 3
联名的房子,一方逝世,另一方自动继承 
Joint Tenancy With Rights of Survivorship 

现今社会很多房子是夫妻是联名购买, 大多数人认为一方逝世, 拥有权将自动归另一方拥有的想法是不正确的。在马来西亚, 只要没有立下遗嘱, 所有的财产将依照1958年遗产分配法令分配。
例如: 男逝世者A逝世后留下了母亲, 兄弟姐妹4人, 妻子和3个孩子。

依照1958年遗产分配法令, A的财产分给母亲25%, 妻子25%, 三个小孩平分50%。男逝世者离逝后遗产处理期间, 年迈的母亲因伤心过度也离开人世, 因此母亲从A获得的25%财产将平分给4位孩子, 不幸的是A的兄弟姐妹中的哥哥过后也相继离世, 结果哥哥的那5%又分给了他自己2个孩子。试想想, A的妻子, 3个孩子, 弟弟, 姐姐妹妹, 还有哥哥的两个孩子都成了房子的部分主人。A留下的屋子到最后分成了9份是怎样的局面?

Without a Will, your assets will be distributed in accordance to the Distribution Act 1958 (Amended 1997). Under the Act, your assets will be divided between your surviving spouse 25%, 3 children equally 50% and parent(s) 25%. More problems arise if your parent(s) pass on soon after you, your assets may be subdivided further between your brothers and sisters etc., resulting in additional claimants!

对于膝下有未成年子女的夫妻来说, 在遗嘱中还应该为子女指定监护人。如果夫妻同时去世又没有在遗嘱中指定监护人, 则小孩的归属将是问题。在这情况下, 监护人是由法官来指定, 当然法官指定的人不一定就是您希望的人。最糟糕的是争取监护权的人, 不一定是为了小孩的利益而来。如果他的目标是这对夫妻的财产的话, 小孩的利益就更得不到保障了。笔者认为, 年轻的夫妻的遗嘱和寿险及理财规划一样重要。

Parents with minor children need to name a personal and financial guardian for their children in case they pass away. After all, death does not respect age, so a Will or estate plan will ensure that your assets are properly distributed according to your wishes in the case of your death. Otherwise, the court will appoint a guardian for your minor children which may not have your children’s interests or welfare at heart.
